Terms of Service

1. Acceptance of these Terms

By creating an account, accessing FAYRWATCH, watching content, uploading content, subscribing, or using any part of the platform, you agree to these Terms of Service and to our Privacy Policy.

If you create a creator account, upload content, or receive creator revenue, you also agree to the creator-specific rules included in these Terms and to any creator payout rules displayed inside your creator dashboard.

If you do not agree to these Terms, you must not create an account or use FAYRWATCH.

2. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we may notify users through the platform, by email, or by another reasonable method.

Your continued use of FAYRWATCH after updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the platform and may close your account.

3. Eligibility

• You must be at least 16 years old to create a viewer account.
• You must be at least 18 years old to create a creator account, upload monetized content, or receive creator payouts.
• If the law in your country requires a higher age to use online services, create accounts, enter contracts, subscribe, upload content, or receive payments, you must meet that higher age requirement.
• You may not create an account using false information, impersonate another person or organization, or create an account for someone else without authorization.

4. Account registration and security

• You are responsible for all activity that happens under your account.
• You must provide accurate, current, and complete information when creating and using your account.
• You must keep your login credentials secure and must not share your password or account access with anyone else.
• You must notify us at contact@croissant.im if you believe your account has been accessed without authorization.
• We may suspend or terminate accounts that appear to be compromised, fraudulent, abusive, inactive for a long period, or in violation of these Terms.

5. Viewer subscriptions

• FAYRWATCH offers viewer access through a paid subscription.
• The current subscription offer is: first month free, then $6.00 USD per month, billed automatically unless cancelled before the next billing date.
• Subscription pricing, free trial length, billing period, currency, included features, and availability may change over time. Any price or subscription details shown at checkout control the transaction at the time you subscribe.
• By starting a subscription, you authorize FAYRWATCH and its payment processor to charge your selected payment method on a recurring basis until you cancel.
• You may cancel your subscription at any time. After cancellation, access normally remains active until the end of the current billing period or trial period.
• Except where required by law or expressly stated by FAYRWATCH, payments for the current billing period are non-refundable.
• FAYRWATCH may offer promotional trials, discounts, or special pricing. We may modify or stop promotions at any time.

6. Payments for viewers

• Payments are processed by Stripe or another third-party payment processor. FAYRWATCH does not store your full card number.
• You agree to provide accurate billing information and to keep your payment method updated.
• If a payment fails, we may retry the payment, suspend access, downgrade your account, or cancel your subscription.
• Taxes, duties, VAT, sales tax, or similar charges may apply depending on your location and the applicable law. If required, taxes may be added to the subscription price or included in the total price shown at checkout.

7. Personal and non-transferable access

• Your viewer subscription is for your personal use only.
• You may not sell, rent, share, transfer, sublicense, publicly perform, rebroadcast, restream, redistribute, record, copy, download, scrape, or otherwise exploit content from FAYRWATCH unless expressly allowed by the platform or by the content owner.
• You may not share your login credentials or give other people access to your paid subscription.
• We may limit, suspend, or terminate accounts that share access, abuse subscriptions, use automated access, or attempt to bypass platform restrictions.

8. Creator accounts

• A creator account allows eligible users to upload content, publish creator profiles, build an audience, and potentially receive creator revenue under the rules displayed on FAYRWATCH.
• Creators are independent users of the platform. Creators are not employees, partners, agents, representatives, or joint venturers of Croissant.im LLC or FAYRWATCH.
• Creators are solely responsible for their content, legal compliance, tax obligations, social charges, business registrations, sponsorship disclosures, and interactions with viewers.
• We may approve, reject, limit, suspend, or terminate creator accounts at our discretion if necessary to protect the platform, users, rightsholders, payment systems, legal compliance, or the integrity of creator payouts.

9. Creator revenue and payouts

• Creator revenue, if available, is calculated under the payout rules, eligibility rules, dashboard information, and platform policies displayed by FAYRWATCH from time to time.
• No creator is guaranteed any minimum revenue, audience, exposure, recommendation, subscriber count, view count, payout, or growth.
• Revenue estimates shown in a dashboard may be preliminary and may change due to refunds, failed payments, chargebacks, fraud review, taxes, payment processor fees, currency conversion, technical errors, policy violations, copyright claims, moderation decisions, or other adjustments.
• FAYRWATCH may change the creator payout model, payout timing, payout thresholds, eligibility requirements, calculation method, or payment processor at any time, with reasonable notice where appropriate.
• FAYRWATCH may withhold, delay, reduce, reverse, or cancel creator payments if we believe there is fraud, artificial inflation of views or engagement, copyright infringement, breach of these Terms, illegal activity, payment processor risk, chargebacks, refunds, tax documentation issues, account verification issues, sanctions risk, or any other legal or compliance concern.

10. Creator payment information and tax documents

• Creators must provide accurate payment, identity, tax, and compliance information before receiving payouts.
• FAYRWATCH may use Stripe, Stripe Connect, or another payment processor to verify creator accounts and process payouts.
• Creators may be required to accept the terms of the payment processor before receiving payouts.
• FAYRWATCH may request tax forms or tax information, including forms commonly used for U.S. tax compliance such as W-9, W-8BEN, W-8BEN-E, or other documents depending on the creator's status and location.
• Creators are responsible for reporting and paying all taxes, social charges, business taxes, VAT, GST, income taxes, withholding taxes, or similar obligations related to their creator revenue.
• FAYRWATCH may report payment information to tax authorities, payment processors, or other parties where required by law.

11. Ownership of creator content

• Creators retain ownership of the videos, images, thumbnails, text, posts, comments, live streams, audio, profile information, and other content they upload or publish on FAYRWATCH.
• Uploading content to FAYRWATCH does not transfer ownership of that content to Croissant.im LLC.
• Creators are responsible for keeping copies of their own content. FAYRWATCH is not a backup service.

12. License granted to FAYRWATCH

By uploading, posting, submitting, streaming, or making content available on FAYRWATCH, you grant Croissant.im LLC a worldwide, non-exclusive, sublicensable, transferable license to host, store, process, reproduce, encode, transcode, compress, adapt, display, stream, distribute, transmit, publicly perform, make available, recommend, promote, and otherwise use the content as necessary to operate, improve, protect, market, and provide FAYRWATCH.

This license allows FAYRWATCH to make your content available to viewers, display it in feeds and search results, create thumbnails or previews, adapt it to different devices and formats, use service providers such as hosting and video delivery providers, and promote the platform using public creator names, profile images, thumbnails, titles, short excerpts, and public creator pages.

This license is non-exclusive, meaning creators may publish their content elsewhere unless a separate written agreement says otherwise.

When you delete content from FAYRWATCH, the license generally ends for future public display of that content. However, copies may remain temporarily in backups, caches, logs, moderation systems, legal records, payment records, dispute records, or where continued retention is reasonably necessary for legal, safety, fraud prevention, accounting, or technical reasons.

13. Creator promises about content rights

By uploading content, you confirm that:

• you own the content or have all permissions needed to upload, publish, stream, monetize, and license it to FAYRWATCH;
• you have all rights needed for music, sound recordings, beats, samples, images, video clips, film excerpts, logos, brands, artwork, thumbnails, voices, performances, locations, and people appearing in the content;
• the content does not infringe copyright, trademark, privacy rights, publicity rights, trade secrets, contractual rights, or any other rights of another person or organization;
• the content does not violate any law or regulation that applies to you or to FAYRWATCH;
• you will not upload content that you know or should know you are not allowed to use.

If a claim, complaint, lawsuit, copyright notice, payment dispute, tax issue, or legal demand arises from your content or conduct, you are responsible for it.

14. Prohibited content

You may not upload, publish, promote, monetize, or share content that:

• is illegal or promotes illegal activity;
• infringes copyright, trademark, privacy rights, publicity rights, or other third-party rights;
• contains sexual content involving minors or exploits minors in any way;
• sexualizes minors or appears to sexualize minors;
• includes non-consensual intimate imagery;
• promotes harassment, credible threats, stalking, or targeted abuse;
• doxxes or exposes private personal information without permission;
• promotes violence, terrorism, violent extremism, or serious physical harm;
• contains graphic violence or extreme gore without legitimate context;
• promotes hatred or unlawful discrimination against protected groups;
• defames, impersonates, or intentionally misleads people about identity or affiliation;
• promotes scams, fraud, fake giveaways, phishing, malware, or deceptive schemes;
• manipulates viewers through false, deceptive, or harmful claims;
• violates Stripe, payment processor, hosting provider, or platform rules;
• is designed to artificially manipulate views, likes, follows, comments, subscribers, watch time, revenue, or recommendations;
• creates legal, safety, operational, or reputational risk for FAYRWATCH.

FAYRWATCH may remove, restrict, age-limit, demonetize, down-rank, block, or otherwise limit content that violates these Terms or creates risk for the platform.

15. Prohibited conduct

You may not:

• share, sell, rent, transfer, or misuse account access;
• use bots, scrapers, crawlers, automated scripts, or other tools to access the platform without permission;
• bypass, disable, or interfere with security, access controls, paywalls, DRM, player restrictions, or anti-fraud systems;
• upload malware, harmful code, or deceptive files;
• interfere with the platform's operation, servers, APIs, databases, or networks;
• reverse engineer, copy, or clone non-public parts of the platform;
• scrape or collect user data without permission;
• create fake accounts, fake views, fake engagement, fake subscriptions, or fake payouts;
• coordinate manipulation of recommendations, rankings, revenue, or metrics;
• harass, threaten, intimidate, or abuse users, creators, staff, or third parties;
• use FAYRWATCH to violate any law or third-party rights;
• help anyone else do anything prohibited by these Terms.

16. Copyright and DMCA policy

FAYRWATCH respects copyright and expects users and creators to do the same.

If you believe content on FAYRWATCH infringes your copyright, send a copyright notice to contact@croissant.im.

A copyright notice should include:

• your full legal name;
• your company or organization name, if applicable;
• your contact information;
• identification of the copyrighted work you claim has been infringed;
• the URL or clear location of the allegedly infringing content on FAYRWATCH;
• a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
• a statement that the information in your notice is accurate;
• a statement that you are the copyright owner or authorized to act on behalf of the copyright owner;
• your physical or electronic signature.

We may remove or disable access to content that is the subject of a valid copyright complaint. We may notify the creator who uploaded the content. We may reject incomplete, abusive, fraudulent, or legally insufficient notices.

If a creator believes content was removed by mistake or misidentification, the creator may contact contact@croissant.im to request review and provide information supporting the request.

FAYRWATCH may suspend or terminate accounts that repeatedly infringe copyright or repeatedly upload content that creates copyright risk.

17. Reporting content and moderation

• Users may report content or accounts that appear to violate these Terms.
• FAYRWATCH may review reports manually, automatically, or through service providers.
• FAYRWATCH may remove content, restrict access, demonetize content, limit recommendations, suspend features, pause payouts, require verification, or terminate accounts when we believe it is necessary to protect users, creators, rightsholders, payment processors, the platform, or legal compliance.
• Where appropriate, FAYRWATCH may allow users or creators to request review of moderation decisions by contacting contact@croissant.im.
• FAYRWATCH is not required to host or continue displaying any content.

18. Rankings, recommendations, and visibility

FAYRWATCH may organize, rank, recommend, feature, promote, or limit content based on factors such as user preferences, follows, watch history, engagement, quality signals, originality, safety, regular posting, compliance with platform rules, technical performance, availability, and editorial or operational decisions.

FAYRWATCH does not guarantee that any content or creator will receive views, followers, subscribers, recommendations, revenue, homepage placement, search placement, or promotion.

19. Sponsors, advertising, and commercial content

• Creators are responsible for disclosing paid promotions, sponsorships, affiliate links, product placements, endorsements, or commercial relationships where required by law or platform rules.
• Creators may not promote scams, illegal products, misleading financial schemes, harmful products, or products or services that violate payment processor or platform rules.
• FAYRWATCH may restrict, demonetize, remove, or require changes to sponsored content or commercial content that creates legal, safety, payment, or reputational risk.

20. Third-party services

FAYRWATCH relies on third-party providers for services such as authentication, database hosting, video hosting and delivery, payment processing, fraud prevention, email delivery, analytics, storage, security, and infrastructure.

Third-party services may have their own terms and privacy policies. FAYRWATCH is not responsible for failures, outages, delays, errors, account reviews, payment holds, or restrictions caused by third-party providers.

21. Third-party links and creator links

FAYRWATCH may contain links to third-party websites, social profiles, products, services, sponsors, or external content.

FAYRWATCH does not control and is not responsible for third-party websites or content. Users access third-party links at their own risk.

22. Platform changes and availability

FAYRWATCH may add, remove, modify, limit, suspend, or discontinue features, content categories, subscriptions, creator tools, payout systems, recommendation systems, prices, or integrations at any time.

FAYRWATCH does not guarantee that the platform will be uninterrupted, secure, error-free, always available, or compatible with every device, browser, country, or internet connection.

23. Account suspension and termination

• You may delete your account from your settings if that feature is available, or by contacting contact@croissant.im.
• FAYRWATCH may suspend or terminate your account, subscription, creator features, content access, payouts, or platform access if you violate these Terms, create legal or payment risk, infringe rights, abuse the platform, fail verification, engage in fraud, or if required by law or by a third-party provider.
• If your account is terminated, your right to use FAYRWATCH ends immediately.
• Certain provisions of these Terms will survive termination, including provisions about content licenses, payment adjustments, taxes, moderation records, disclaimers, limitation of liability, indemnification, governing law, and disputes.

24. Disclaimer

• FAYRWATCH is provided on an "as is" and "as available" basis.
• To the maximum extent permitted by law, Croissant.im LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, security, and uninterrupted operation.
• FAYRWATCH does not endorse, verify, or guarantee user-generated content. Creators are responsible for their own content.
• FAYRWATCH does not guarantee earnings, business results, audience growth, creator success, viewer satisfaction, platform availability, ranking, recommendation, or continued access to any specific content.

25. Limitation of liability

• To the maximum extent permitted by law, Croissant.im LLC and its owners, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, including loss of data, loss of revenue, loss of goodwill, loss of audience, lost creator income, account suspension, content removal, payment holds, service interruptions, or third-party provider failures.
• To the maximum extent permitted by law, Croissant.im LLC's total liability for any claim related to FAYRWATCH will be limited to the amount you paid to FAYRWATCH in the three months before the claim arose, or $100.00 USD if you did not pay FAYRWATCH during that period.
• Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, the limitations apply only to the maximum extent permitted by law.

26. Indemnification

You agree to defend, indemnify, and hold harmless Croissant.im LLC and its owners, officers, employees, contractors, service providers, and affiliates from any claims, damages, losses, liabilities, costs, fees, and expenses, including reasonable legal fees, arising from or related to:

• your content;
• your use of FAYRWATCH;
• your violation of these Terms;
• your violation of any law or regulation;
• your violation of another person's rights;
• your fraud, misconduct, or artificial manipulation of platform metrics;
• your tax, payment, sponsorship, or business obligations.

27. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules.

To the extent a dispute cannot be resolved informally, you agree that disputes related to these Terms or FAYRWATCH will be brought in the state or federal courts located in Pinellas County, Florida, United States, unless applicable law requires another forum.

Before filing a claim, you agree to first contact FAYRWATCH at contact@croissant.im and try to resolve the dispute in good faith.

28. Miscellaneous

• These Terms, together with the Privacy Policy and any rules displayed on the platform, make up the agreement between you and Croissant.im LLC regarding FAYRWATCH.
• If any part of these Terms is found unenforceable, the remaining parts remain in effect.
• FAYRWATCH's failure to enforce any part of these Terms is not a waiver of our right to enforce it later.
• You may not transfer your account or rights under these Terms without our permission. Croissant.im LLC may transfer these Terms in connection with a merger, acquisition, sale of assets, restructuring, financing, or change of control.
